  • Exceptions: Small claims court disputes are exempt from arbitration.
  • Costs: AAA and arbitrator fees follow AAA Rules. Each party bears its own legal costs unless the arbitrator awards otherwise.
  • Non-Arbitration: If the class action waiver is unenforceable, disputes must be brought in court in Haleiwa, Hawaii.
  • Time Limit: Claims must be filed within one year of arising.

 

16. Digital Millennium Copyright Act (DMCA)
